ACCUSED OF ASSAULT.

Gas Company Employee Alleges Trojan Attacked Him With Pickaxe

Thomas Humes, fifty-eight years old, of 449 Tenth Street was arraigned before Police Justice Byron this morning on a charge of assault in the second degree, preferred by Michael Murphy, an employee of The Troy Gas Company. The complainant alleges that April 17 last he went into the cellar of the defendant to shut off the gas and was struck on the left shoulder with a pickax wielded by Humes. Murphy claims he is temporarily disabled because of the alleged assault. The defendant requested a hearing In Police Court and the case was adjourned to April 28, and Humes was released on $1,000 ball, the bond being signed by Peter Schneider.

THE TROY TIMES, TROY, N. Y., MONDAY EVENING, APRIL 23, 1922.

Thomas Humes of 449 Tenth Street was held to await the action of the Grand Jury on a charge of assault in the second degree, preferred by Michael Murphy, a collector for The Troy Gas Company, who alleged the defendant struck him on the left shoulder with a pickax. Clark Cipperly represented the complainant and Thomas F. Phelan appeared for the defendant. Mr. Humes denied having used a pickax, but admitted striking the young man with his fist after the complainant had insisted on trying to enter the defendant's cellar. Dr. Edward J. Hannan testified to having attended Murphy, who was suffering from abrasions on the left shoulder and unable to use the Injured arm.

Arraigned on Indictment.

Thomas Humes, indicted by the recent Grand Jury for assault, second degree, was arraigned on a bench warrant this morning. He entered a plea of not guilty and bail was fixed at $1,500. Humes Is alleged to have attacked an employee from The Troy Gas Company, where the latter went to his home on Ninth Street to shut off the gas.

The funeral of Thomas J. Humes was held at 9:30 a.m today from the McLoughlin Funeral Home, Glen and 6th Aves. and at 10 a.m. from St. Patrick's Church where a Requiem High Mass was celebrated by Rev. J. Francis Whalen. Peter J. Bertasso presided at the organ and Mrs. Lillian Teta sang "Domine Jesu Christe" at the offertory and "Mother Dear. O Pray For Me" at the recessional. Bearers were George P. Edwards, Bernard J. Carroll. William F. Brett, Walter J O'Neill, Walter E. Delaney and Joseph T. Humes. Interment was in St. Peter's Cemetery with Father Whalen officiating at the grave. Last evening Father Whalen, along with a delegation from the Holy Name Society of St. Patrick's Church, visited the funeral home and recited prayers.

Thomas Humes, 98, Long Ill. Expires At Nursing Home

Thomas J. Humes, 98, one of the oldest members of, St. Patrick's Church, and a charter member of the Holy Name Society of that church, died last night at the Nightingale Nursing Home following a long illness.

Born in Ireland, Mr. Humes had been a communicant of St Patrick's Church for more than 70 years. He was employed by the Troy Water Works at Tombannock Reservoir prior to his retirement in 1938. He was the last surviving member of the Sovereign Camp No. 6, Woodmen of the World. Husband of the late Margaret J. Gillan and father of the late Sgt Joseph T. Humes, Mr. Humes is survived by his daughter, Mrs. J Edward Miller and several nieces and nephews. The funeral will be held Friday at 9.S0 a.m. from the McLoughan Funeral Home, Glan and 6th Avee., and at 10 am. from St Patrick's Church. There a Requiem High Mass will be celebrated. Interment will be in St Peter's Cemetery.
